Terms of Service

By accessing or using Identity OS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description

Identity OS provides a behavioral runtime control API for AI agents. The Service processes observations, maintains stateful identity models, and returns ExecutionContracts that constrain agent behavior.

2. Accounts and API Keys

  • You must register for an account to use the Service.
  • You are responsible for safeguarding your API keys.
  • You must not share, publish, or embed API keys in client-side code.
  • One license key corresponds to one active deployment. Multi-use requires separate licenses.

3. Acceptable Use

You may use the Service to:

  • Integrate behavioral control into your AI agents
  • Process observations and receive ExecutionContracts
  • Use SDKs and documentation for integration purposes

You may not:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or internal mechanisms of the Service
  • Attempt to reconstruct, replicate, or create a substitute for the Service's behavioral engine, drift detection, stress model, or contract generation systems
  • Systematically probe, scrape, or extract data from the API for the purpose of reconstructing the Service's internal logic or training competing models
  • Use automated tools to map, benchmark, or reverse-engineer the Service's thresholds, parameters, or algorithmic behavior
  • Circumvent, disable, or interfere with rate limiting, authentication, or other security features
  • Use the Service for any unlawful purpose
  • Sublicense, resell, or redistribute API access without written permission

4. Intellectual Property

  • The Service, including its algorithms, models, persona definitions, mode profiles, drift detection mechanisms, stress models, and all associated intellectual property, is owned by Identity OS.
  • Your use of the Service does not grant you any ownership rights over the underlying technology.
  • API responses (ExecutionContracts, snapshots, drift events) are operational outputs for your integration use only and do not constitute a license to the underlying algorithms.

5. Rate Limits and Quotas

  • Each subscription tier includes defined monthly cycle limits and rate limits.
  • Exceeding limits may result in throttled or rejected requests.
  • Abuse of free-tier accounts (e.g., creating multiple accounts to circumvent limits) is prohibited and may result in termination.

6. Payment and Billing

  • Paid subscriptions are billed monthly through our payment processor (LemonSqueezy).
  • All fees are non-refundable unless required by applicable law.
  • We reserve the right to change pricing with 30 days' notice.
  • Downgrading your plan takes effect at the end of the current billing cycle.

7. Data and Privacy

  • We process observation data solely to provide the Service.
  • We do not sell, share, or use your data to train models.

8. Service Availability

  • We aim for high availability but do not guarantee uninterrupted service.
  • We may perform maintenance with reasonable notice.
  • The Service is provided "as is" without warranty of any kind.

9. Limitation of Liability

To the maximum extent permitted by law, Identity OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

  • You may cancel your subscription at any time.
  • We may suspend or terminate your access if you violate these Terms.
  • Upon termination, your API keys are deactivated and your instance data is deleted after 30 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
